1. What Makes Us Unique

Thank you for utilizing our Service! FnF is a social information-entertainment app designed and developed by FnF in Dhaka, Bangladesh. FnF is referred to as “FnF,” “us,” “our,” and “we” in this document.

2. How Does This Policy Apply?

By checking the “I Agree” box, you agree to be subject to and bound by this Privacy Policy (this “Policy”) and (ii) our Terms of Service (the “Terms”) (collectively, the “Agreement”). You must not use the Service if you are unwilling or unable to be bound by the Agreement.

This Policy only applies to information collected via the Service. It does not apply to any third-party applications, services, or websites accessed via the Service. This Policy does not apply to any third-party information provided or collected. If this Policy does not apply to you, you should read the applicable privacy policy and related terms on the website, application, or other service you are using before providing any information.

3. What Information We Gather and How We Use It

To provide, support, improve, and market the Service, we must collect some of your personal information. We may collect personal information in a variety of ways, including information that you provide us directly.

We will most commonly use your personal information in the following situations:

•  Because it is necessary and reasonable for us to do so in order to provide the Service you have requested, or to comply with your instructions or other contractual obligations between you and us.

•  To meet our legal obligations and keep records of our compliance processes.

•  Because you have chosen to publish or display your personal information on the Service’s public areas.

•  Because it is essential to safeguard your vital interests.

•  Because it is in the public’s interest.

•  Because you have expressly granted us permission to process your personal information in a specific manner.

Other than as described herein, we do not use your personal information to make automated decisions affecting or creating profiles. Please keep in mind that the examples below include different types of personal data we may have about you, not necessarily information we have received about you.

i. Permissions for Device Access and Registration Information.

Registration Details. This includes information you provide when you create an account with us. When you register for the Service, you can provide your mobile number or email address, first and last name, as well as a username, during the registration of your profile.

Permissions for Camera and Video Access. This device access permission grants the Service access to your device’s camera and the ability to capture images/video from the device, including photos stored on the device. If you grant this access permission, the Service will be able to save photos and videos on your device as well as access photos and videos that are already on your device. You won’t be able to send or upload photos from your camera, for example, unless you’ve given us permission to access your camera and photos.

Recognition of Speech. We use this device access permission to recognize spoken words in recorded or live audio, and we use it to recognize verbal commands and handle text dictation. Speech recognition involves recording audio of the user’s voice and sending it to servers for processing. These servers are run by Apple or Android, depending on your device’s operating system. When the Service first requests permission to use speech recognition, it will prompt you to accept or deny the request. The system remembers the user’s choice so that future requests do not prompt the user again. This permission can be changed in your device’s settings.

Notifications by Push. You may grant us permission to send you push notifications on your device when you use the Service. You can opt out of receiving these types of communications at any time by changing the settings on your mobile device.

How do we make use of Registration Data and Device Access Permissions?

•  To allow you to sign up for, access, and use the Service, including managing user information and accounts.

•  To grant you password-protected access to your account and access to certain interactive features of the Service.

•  To personalize your experience, conduct research and development to test and introduce new features and products, and improve and monitor the effectiveness of our Service.

•  To improve and personalize our Service, as well as to target features that may be of greater interest to you.

•  For any other purpose that we expressly communicate to you when collecting that information with your consent, or for which we have a legitimate interest.

What else should you know about Device Access Permissions and Registration Information?

Data on location. When you use the Service, you may grant us permission to collect real-time information about your mobile device’s location. What is the purpose of Mobile Advertising Identifier Data?

•  On the Service, we use mobile advertising identifier data to deliver content, including ads relevant to your interests.

We may also collect or request anonymous or non-personally identifiable data and information from you that, unless combined with personally identifiable information, cannot identify you as an individual and must be separated in a commercially reasonable manner to prevent re-identification.

For example, we may collect aggregate statistical data (e.g., how long users have been watching video) for audience and performance purposes, such as calculating the percentage of users who live in a specific region.

How do we make use of anonymized and aggregated data?

•  We build language models using aggregated data from your chat history to help us improve the Service.

•  We used aggregated data for research and statistical purposes to better understand our users’ interests, analyze trends, improve the Service, and personalize the user experience.

5. Information We Disclose to Third Parties

We may share your information with parties other than FnF or its users (collectively, “Third Parties”) in addition to using it for the purposes described above. We may ask for your permission before sharing your information in some cases, but we reserve the right to share your information with Third Parties without prior notice or without seeking additional permission when required by law.

We may share your personal information in the following circumstances:

•  Legal and law enforcement services. When we believe in good faith that applicable law requires it, we may disclose your personal data in response to subpoenas, warrants, court orders, or other legal processes, or to comply with relevant laws or regulatory investigations.

We may also share your personal information to establish or exercise our legal rights; to defend against a legal claim; and to investigate, prevent, enforce, or take other action regarding possible illegal activities, suspected fraud, threats to the safety of persons or property, or a violation of our Terms of Service or other policies or agreements.

•  Employees, business partners, and middlemen We disclose your personal information to our affiliates, subsidiaries, or divisions, and their respective officers, directors, employees, accountants, attorneys, and agents, or to our business partners, all of whom are bound by all of the confidentiality and other data processing safeguards and practices described in this Policy, use your information strictly to carry out their job duties on a need-to-know basis, and do so only as required by law and as required by our business partners.

•  Our Suppliers. Our Service is supported by third-party vendors, who may have access to your personal information while performing services for us (such as hosting). Service Providers may, among other things, assist us in administering the Service, supporting our provision of products and services requested by you, providing technical support, sending marketing and promotions to you, communicating with you about our products and services, assisting with payment processing and related issues, and assisting with other legitimate legal purposes. We contractually require such vendors to keep your information confidential and to take appropriate security measures. We prohibit such vendors from using or sharing your information for any other purpose than performing specific services for us that are required to maintain and update our Service. During the course of their work, our vendors may access our web server on a regular basis and/or use analytics technologies that may automatically collect and store the following general information about you: the originating name of the domain from which you access the Internet; the date and time you access the Services; the pages you visit; the Internet address of the website from which you linked directly to the Service; and the browser you use to access the Service. This information is used to help us improve the Service by compiling statistics about your use of our Service (such as error incidence and referrer origin) to make them more useful to you.

•  Others who use FnF. In response to your request to share photos, videos, or posts, we may disclose your personal information. For example, if you choose to share such content with “friends of friends,” your posts will be shared with “friends of friends” and, depending on reshares and likes, with other FnF users.

•  Support from a third party. We will collect and may disclose your name, email address, other contact information, and other information to third parties as needed to respond to your feedback, request for support, or answer your question if you provide us with feedback, contact us for support, or ask us questions via web form, telephone, email, or other method allowed by our Service.

•  Corporate Transformation. Without your permission, we may sell, transfer, or otherwise share some or all of our assets in connection with a merger, reorganization, or asset sale, or in the event of bankruptcy. In such a case, your personal information may be included among the assets transferred.

•  Data in aggregate. We disclose aggregated information about the Service and FnF users to third parties (including, without limitation, advertisers, media, and actual or potential partners or investors) for informational, new product development, marketing, and/or promotional purposes without obtaining additional consent from you, when such aggregated information does not identify you or any specific individual, as is the case with demographic data groupings and customer preferences.

•  Advertisers. We permit third-party advertising partners to collect the advertising identifier and IP address from your mobile device, as well as to install tracking tools (e.g., cookies) on your browser in order to collect information about your activities (e.g., your IP address, the pages visited, and the corresponding time of day). We also share de-identified information with third-party advertising partners, as well as selected personal information (e.g., device identifier) that we have collected. This information (and similar information collected from other websites) is used by these advertising partners to deliver targeted advertisements to you when you visit non-FnF related websites within their networks. This is also known as “interest-based advertising” or “online behavioral advertising.” We may grant access to other data collected by the Service in order to facilitate the transmission of information that you may find useful, relevant, valuable, or otherwise of interest. If you prefer that we not share your personal information with third-party advertising partners, please follow the instructions in Section 6 below. Third parties who provide advertising or other functionality on our Service may collect the same information about your mobile device that we do automatically.

6. Choosing Not to Receive Communications

As discussed below, you have the right to opt out of certain uses and disclosures of your personal information.

Text messages and emails. We will only send you direct marketing communications via email or text message with your permission or when required by law. If you decide that you do not want to receive marketing emails from us, you can opt out of receiving future marketing emails by clicking the unsubscribe link at the bottom of the email. We will process your request as soon as possible after receiving it.

In contrast, we also use email or in-app messaging to respond to your customer service requests, provide certain transaction-related communications about products or services you have requested, and communicate certain non-promotional issues about FnF and our Service (e.g., communications regarding updates to our Terms or this Privacy Policy). You cannot opt out of receiving these communications without deactivating your account, and you will continue to receive them even if you opt out of receiving marketing communications from us.

Mobile Device Push Notifications. FnF may send you push notifications via our Service on occasion. You can opt out of receiving these types of communications at any time by changing the settings on your mobile device.

Technologies for interest-based advertising. As previously stated, you can limit advertising tracking via advertising identifiers by adjusting the privacy settings on your mobile device. The online advertising industry also offers websites where you can opt out of receiving targeted ads from our data partners and other advertising partners who participate in self-regulation programs. You can find them, as well as learn more about targeted advertising, consumer choice, and privacy, at https://www.networkadvertising.org/mobile-choice, https://www.youronlinechoices.eu/, and http://www.aboutads.info/choices/.

7. Access, rectification, erasure, and restriction rights

We provide reasonable access to and control over your personal data at any time, free of charge, unless there are exceptional circumstances. Please familiarize yourself with your legal rights by reviewing the list below. To exercise your rights and choices, please see the “Contact Us” section at the end of this Policy.

We make every effort to respond to all legitimate requests for your personal information within one month. If your request is particularly complex or you have made a number of requests, it may take us longer than a month. We will notify you and keep you updated in such cases. The timeframes described here do not apply to our response times for dealing with routine customer service and support requests that are not related to the exercise of personal information access rights.

Although FnF makes commercially reasonable efforts to provide individuals with access to their personal information and respond to their requests, there may be times when FnF requires additional information in order to identify your account, and we may require you to demonstrate your identity. FnF may be unable to provide access if you are unable to demonstrate your identity. This can happen (a) if the information contains legal privilege; (b) if complying with the request would jeopardize others’ privacy or other legitimate rights; (c) if the burden or expense of providing access would be disproportionate to the risks to the individual’s privacy in the case at hand; or (d) if the information is commercially proprietary. If FnF determines that access should be restricted in a specific case, we will provide you with an explanation as well as a contact point for any further inquiries. FnF will take commercially reasonable steps to verify your identity before granting access to or making changes to your personal information to protect your privacy.

•  Access request. You have the right to request a copy of the personal data we have on file for you, as well as information about the data’s origin, recipients, and purposes. However, there are some exceptions to this right, and we may deny access to you if required by law or to protect the legal rights of others. In the Service, you can request a download of your account information. To request a download, go to the “Request Account Info” button in the Service’s Settings section.

•  Request correction. You have the right to request that we correct any personal information we have on file for you. This allows you to have any incomplete or inaccurate information we have about you corrected, though we may need to verify the accuracy of the new information you provide to us. We strive to keep your personal information accurate, up to date, and complete. Please contact us if you believe your information is incorrect or if it has changed. You can change your account information using the Service.

•  You have the right to have your personal information erased and deleted. You have the right to request that we delete your personal information when it is no longer required for the purposes for which it was collected or when it has been unlawfully processed, among other things. You can delete your entire FnF account by going to the settings and selecting the “Delete FnF account” option. We may also decide to delete your personal information if we believe it is incomplete or inaccurate, or if we believe that continuing to store it is contrary to our legal obligations or business objectives. When we delete personal information, it is removed from our active servers and databases, as well as from our Service, but it may remain in our archives if deletion is not practical or possible. We may also retain your personal information as necessary to comply with our legal obligations, resolve disputes, or enforce any agreements, such as limited information about your mobile device for the purposes of fraud detection and enforcement of our Terms of Service.

•  The right to object. You have the right to object to the processing of your personal information in certain circumstances, as permitted by applicable law, and to request that we erase or restrict our use of your personal information. If you want us to stop using your personal information, please contact us and we will let you know if we can accommodate your request.

•  The right to portability. You have the right to request that some of your personal data be provided in a commonly used, machine-readable format to you or an authorized third party. In the Service, you can request a download of your account information. To request a download, go to the “Request Account Info” button in the Service’s Settings section. If you require direct data transfer to another responsible party, this will be done only to the extent technically possible.

•  Consent Can Be Withdrawn. You have the right to withdraw your consent to the collection, processing, and transfer of your personal information if you have given it. We make every effort to accommodate all reasonable and legitimate requests. As previously discussed, you can change the permissions and settings on your mobile device and the Service to restrict access to specific information. To withdraw your consent to receive emails and other communications from us, please notify us or use the opt-out links provided in the communications you receive. We will no longer process your information for the purpose(s) to which you originally consented once we have received notice that you have withdrawn your consent, unless there are compelling legitimate grounds for further processing that override your interests, rights, and freedoms, or for the establishment, exercise, or defense of legal claims. The withdrawal of consent to receive marketing communications has no effect on the processing of personal information for the purposes of providing our Service. Changing the permissions and settings on your mobile device or within the Service, on the other hand, may cause certain features of the Service to stop working.

We are not liable for any losses caused by inaccurate, inauthentic, deficient, or incomplete personal information that you provide to us.

8. Retention of Data

We will keep your personal information for as long as necessary to fulfill the purposes for which it was collected and to provide you with the Service. As a result, data retention periods may vary depending on the Service features for which the data was provided. We cannot, however, guarantee that other users will not record live feeds or other information you share with them, and another user may have a copy of information even if you and we delete it.

We will also keep and use your personal information for as long as is necessary to comply with our business requirements and legal obligations, resolve disputes, protect our assets, provide our services, and enforce our agreements. When we no longer need your personal data for any reason, we will use commercially reasonable efforts to securely destroy it in accordance with applicable law and our policies.

9. Data Safety

We maintain appropriate technical and organizational safeguards to prevent your personal information under our control from being accidentally lost, improperly used or accessed, altered, or disclosed during collection, storage, and processing. All information you provide to us is kept secure on our limited-access servers behind firewalls. Access to your account, personal data, and information is limited within our organization to employees and trusted partners who require access to your personal information in order to correspond with you and provide the products and/or services that you requested from us. Your personal data and information are also password-protected, allowing only you to access your account. Any additional safeguards used to protect personal information will be determined by the sensitivity of the information, its quantity, distribution, and format, as well as the method of storage.

While our security measures aim to protect your personal information while it is in our possession, no security system is perfect, and we cannot guarantee that your personal information will remain absolutely secure in all circumstances, or that any privacy settings or security measures used in connection with the Service cannot be circumvented. As a result, we cannot guarantee that unauthorized third parties will not be able to defeat those safeguards or access and/or use your personal information for improper purposes.

The majority of communications on our Service, including any submissions via available forms, are sent via the standard HTTP protocol, and completed forms may be delivered via regular e-mail. Information sent over HTTP and email is not encrypted; and, while these are convenient communication mechanisms, their use poses privacy and security risks (e.g., e-mail is not a secure form of communication, is unreliable, can be forwarded, etc.). Any information you transmit to us or through our Service is at your own risk.

It is also up to you to ensure the safety and security of your personal information. You are responsible for keeping your password confidential if you use it to gain access to restricted areas of the Service. Do not reveal your password to anyone else. Social networking, messaging, and other features are examples of restricted areas of the Service. Please take care not to submit any personal information that you do not want other users to see, collect, or use when using these features.

If we become aware of a breach in a security system, we may attempt to notify you electronically by posting a notice on the Service. When required by applicable law, we will notify you and any applicable regulator if a security breach results in an unauthorized intrusion into our Service or systems that compromises your data.

10. International Transfer

Our corporate headquarters are in Dhaka, Bangladesh. We store and process your personal data and information in a cloud service hosted outside of Bangladesh or in your home country. Be aware that your personal data and information may be transferred to, stored in, and processed in third countries that may not provide the same level of data protection as your home country.

11. Privacy of Children

FnF does not knowingly collect personal data from children under the age of 14 (or the relevant age in your country where you are considered a minor), and the Service is not directed to children under the age of 14 (or the relevant age in your country where you are considered a minor).
